Terms of Use (English)

Notice: By using this software, you explicitly agree to all the terms listed below without exception.

1. Purpose of the System: Al-Kanjali System is a specialized accounting platform developed to manage and organize the accounting, inventory, and financial operations of businesses operating in the gold and silver sector. It is not a licensed financial entity and does not offer investment or money transfer services.
2. Foreign Currencies: The inclusion of foreign currencies within the system is solely for accounting documentation purposes and shall not be interpreted as encouragement or promotion of any financial activity that violates applicable regulations. The Iraqi Dinar is the only legally recognized official currency within the Republic of Iraq.
3. Non-Refundable Payments: All financial transactions related to subscription, purchase, or activation of the system are final and non-refundable, unless a documented and critical technical malfunction directly affecting core system usage is proven, subject to evaluation by the developer’s technical support team.
4. Payment and Activation Process: Activation of the subscription is processed after verifying receipt of payment through approved methods (such as bank transfers or electronic platforms) within a period not exceeding 24 business hours. Trial periods are only granted if officially announced by the developer.
5. Acceptable Use of the System: It is strictly prohibited to use the system in any manner that could negatively affect performance or compromise security. This includes, but is not limited to, unauthorized access attempts, hacking, reverse engineering, or insertion of malicious code or suspicious instructions into the system environment.
6. User Responsibility: The user assumes full responsibility for the accuracy and validity of all data entered into the system and is solely accountable for the manner in which the system is used. The developer bears no liability for legal or operational consequences arising from incorrect data or misuse, whether intentional or not.
7. Updates and Support: The developer reserves the legal right to implement software modifications, update features, or temporarily disable certain functionalities when operational necessity dictates, without prior notice, provided that core system usability remains intact. Technical support is available exclusively during official working hours.
8. Disclaimer of Liability: Under no circumstances shall the developer be held liable for any legal or financial consequences resulting from user reliance on system outputs for making administrative, financial, or legal decisions. The use of such outputs is at the user’s own discretion and risk.
9. Invoices and Reports: All documents generated by the system, including invoices and reports, are for internal organizational documentation purposes only and must be verified and validated by legally certified professionals before being submitted to any official authority.
10. Acceptance of Terms: Using the system constitutes an explicit legal acknowledgment by the user that they have read, understood, and agreed to all terms and conditions stated herein, without reservation or the need for a separate signature.
11. License: The user is granted a non-exclusive, non-transferable license to use the system during the subscribed period only. This license does not confer any intellectual or operational ownership rights beyond the authorized use scope.
12. Intellectual Property: All intellectual, technical, and programming rights related to the system—including source code, interface, design, and operational mechanisms—belong to the developer. Reproduction, modification, redistribution, or use of these elements in any form without explicit written permission is strictly prohibited.
13. Single Account Use: Each subscription is allocated to a single account representing one entity (individual or company). Sharing login credentials or system access with any third party is strictly prohibited without prior written authorization from the developer.
14. Data Backup: The user is solely responsible for regularly creating data backups using the available technical tools. The developer bears no responsibility for any data loss or damage resulting from the user’s failure to perform this procedure.
15. Integration with Third Parties: If the system is linked with third-party services (such as currency or precious metals rates), the developer holds no liability for the accuracy, availability, or continuity of those services. Use of such services is at the user’s full responsibility.
16. Modification of Terms: The developer reserves the right to amend, update, or rephrase any part of these terms at any time. Such changes become binding upon the user once notified via official communication channels such as email or the system interface.
17. Governing Law: These terms are governed by the laws and legislation of the Republic of Iraq. Any disputes arising shall be referred to the competent Iraqi courts after an amicable resolution attempt within seven (7) business days.
18. Prohibited Activities: The system may not be used for any suspicious or illegal activities, including but not limited to document forgery, asset concealment, tax evasion, money laundering, or entering fraudulent data with the intent to deceive or manipulate financial outcomes.
19. Subscription Duration and Renewal: The subscription remains valid according to the selected time plan (monthly or yearly) and is renewed either automatically or manually as previously agreed. The developer may suspend service if payment is delayed or the term ends without renewal.
20. Service Termination: The developer has the right to suspend or terminate the user’s account if a clear violation of the terms is committed or payment is withheld. No compensation or refund is owed in such cases.
21. Technical Support: Technical support is available exclusively during official business hours and does not include data setup for the user, recovery of manually deleted data, resolution of issues arising from unsupported devices, or password recovery in case of loss. Users must follow the system’s internal recovery procedures.
22. System Compatibility: The developer does not guarantee compatibility of the system with all devices or operating systems, particularly those no longer officially supported. It is recommended to use a modern and compatible operating environment for optimal performance.
23. Notifications: The user explicitly agrees to receive service-related notifications, updates, or promotional messages through communication channels linked to their account, such as email or system pop-ups.
24. Data Protection: User data is stored locally on the user’s device unless the cloud option is activated. Data is secured using advanced encryption algorithms in accordance with international digital security standards.
25. Cloud Storage: When the cloud storage feature is enabled, data is backed up on secure servers inaccessible to any external party and is not used for any purpose unrelated to service provision or technical support.
26. Account Security: Users are responsible for keeping their login credentials confidential. The developer shall not be liable for any unauthorized access resulting from negligence or failure to safeguard such credentials.
27. Technical Support Access: The technical support team may, if necessary, temporarily access system data for diagnostic or resolution purposes, only after obtaining explicit consent from the user and documenting the access process.
28. Data Deletion: Users may submit an official request to delete their data stored on cloud servers. The developer will process such requests within a maximum of three (3) business days after verifying the requester’s identity.
29. Synchronization Risks: The synchronization feature depends on a stable and high-speed internet connection. In case of network disruptions or delays, data updates may be delayed without the developer bearing any direct liability.
30. Account Transfer or Ownership Change: It is not permitted to transfer or assign the account to another party, whether for consideration or otherwise, without prior written approval from the developer. Unauthorized use by any third party is a clear violation of the terms.
31. Limited Liability in Exceptional Cases: The developer makes every effort to secure data according to accepted standards. However, they shall not be held directly liable for damages resulting from extraordinary circumstances beyond their control, such as cyberattacks or third-party system failures. Users are advised to maintain regular backups as a precautionary measure.
